Hopefully Justice Stephen Breyer just got a little tongue tied, if not, pretty scary!
I don't know all the details and this is the first I have read on this issue but no one is alive right now who owned any of that land when the railroads were built which means they bought or inherited that land knowing there was a railroad and associated right of way. Will be interested to see how this plays out.
